TERMS & COMERCIAL CONDITIONS
COMPANY
Magnífico Douro Eventos Lda, headquartered at Rua Marginal do Pinhão – Plataforma C; 5085-037 Pinhão – Portugal, NIF 509 421 361 and RNAAT 114/2011, and Magnífico Douro II Cruzeiros Lda, headquartered at Rua Marginal do Pinhão – Plataforma C; 5085-037 Pinhão – Portugal, NIF 513 922 652 and RNATT 807/2016, hereinafter referred to as Magnífico Douro, provide customers with the experiences presented on this site.
The experiences provided to the client can be carried out by Magnífico Douro or by its partners, in a group – regular experiences, or exclusively for the client – private experiences.
RESERVATIONS
All reservations must be made through the email [email protected] or through our website using our own form, and will only be considered after receipt of proof of payment.
Quotations provided by Magnífico Douro are valid for 30 days.
Magnífico Douro assumes no responsibility if the information provided for the promotion and dissemination of its services is not accurate or complete.
PAYMENTS
Payment for regular experiences must be made at the time of booking.
Payment for private experiences must be made in full at the time of booking, or, alternatively, fifty percent paid at the time of booking and the remainder up to thirty days before the date of execution of the experience.
Magnífico Douro reserves the right to cancel any reservation that does not respect the conditions described above.
The reservation is only valid when confirmed by Magnífico Douro.
Booking conditions may vary depending on the type of experience.
The prices indicated on the website are in euros and include the current VAT rate.
The customer must, upon arrival for the experience, present proof of reservation and the respective payment.
DELAYS
In case of delay by the customer for a regular experience, it may be carried out at a later time on the same or another day, if Magnífico Douro is available for this. If there is no such availability, no refund will be made.
In the event of a customer delay in carrying out a private experience, Magnífico Douro may not carry out the experience, without any refund or compensation. If the experiment is carried out, it may end at the time initially scheduled, or, if possible, maintain the initial duration, in which case an additional amount will be charged corresponding to the increased allocation of resources to the experiment, or other expenses, such as for example accommodation, meals, transport or overnight stays.
CLIENT CANCELATION
For regular experiences, once the reservation is made, the following cancellation fees will apply to the customer: up to forty-eight hours from the beginning of the experience – no cost; less than forty-eight hours before the beginning of the experience – cost of one hundred percent of the value of the experience.
For private experiences, once the reservation is made, the following cancellation costs will apply to the customer: up to thirty days from the beginning of the experience – free of charge; up to forty-eight hours from the beginning of the experience – cost of fifty percent of the value of the experience; less than forty-eight hours before the beginning of the experience – cost of one hundred percent of the value of the experience.
The cancellation request must be in writing to the email [email protected].
Refunds will be processed within 30 days of ordering and approval.
MAGNÍFICO DOURO CANCELLATIONS
Magnífico Douro reserves the right to cancel, without penalty for the company itself, the carrying out of experiences when there are bad weather conditions, unfavorable navigability, damage to vessels, unavailability of locks, unavailability of berthing places, unavailability of third parties, unforeseen delays, pandemics, strikes, among others, or if the minimum number of participants is not verified, and customers who have paid in the meantime will be refunded in the amount of the payment made in the meantime.
In the cases described above, the customer may choose to return the amount already paid or exchange it for another experience suggested by Magnífico Douro, with the respective price variation. These cancellations do not imply the payment of any additional compensation.
CHANGES
Magnífico Douro reserves the right to change itineraries and/or schedules, replace vessels or crew, whenever there are unforeseen situations beyond its control.
Magnífico Douro also reserves the right to change, suspend or eliminate any of its transport experiences and services, as well as to change the respective prices, without prior notice and without the obligation to compensate third parties for the operated modifications.
CLAIMS AND REIMBURSEMENTS
All claims and reimbursements requests must be made in writing to the [email protected] e-mail address no later than five days after the date of the experiment.
COMMUNICATIONS
All communications to be made to Magnifico Douro within the scope of these terms and conditions must be sent to the e-mail address [email protected] indicated on the website.
GOVERNING LAW AND JURISDICTION
The Portuguese Law shall apply to all matters governed by these conditions.
In order to settle all emerging litigation, the forum of the Peso da Régua district is agreed, with express waiver of any other.
DATA PROTECTION
Magnífico Douro respects and complies with the legal provisions regarding the protection and privacy of personal data.
Magnífico Douro uses the technical means at its disposal to prevent loss, misuse, alteration, unauthorized access and / or misappropriation of personal data that was provided, guaranteeing the privacy and protection of the data entrusted to it.
The data provided to Magnífico Douro are processed by computer and are destined to the strict scope of its commercial activity.
The client consents to Magnífico Douro the treatment and management and use of the data provided by him, whether of a personal nature or of a patrimonial nature.
The client expresses to Magnífico Douro the expression of his desire to receive promotional information, as well as authorization for the transmission of his data to other companies, his partners, for promotional campaigns.
The client authorizes Magnífico Douro to collect cookies in order to facilitate its use of the website.
If Magnífico Douro promotes the subcontracting of services to third parties to pursue the purposes of this contract or yields its contractual position, it is authorized to provide the personal data of the client, conditioned to its precise scope.
The client has the right to access, rectify, modify or cancel all personal data, through a communication sent to Magnífico Douro, via the e-mail address [email protected]
INSURANCE
The responsibility of the Magnifico Douro is guaranteed by insurances required by Portuguese Law.
